2. SCOPE AND APPLICATION

These Terms of Service (ToS) govern the contractual relationship between:

  • Notie AI, publisher of the AI-powered automatic grading platform
  • The User, individual or entity subscribing to the services

Use of our services implies full acceptance of these Terms of Service.

3. SERVICE DESCRIPTION

3.1 Main Service

Notie AI provides an automatic grading platform for handwritten assignments using artificial intelligence, including:

  • Advanced Optical Character Recognition (OCR)
  • Automatic evaluation by subject-specialized AI
  • PDF report generation with detailed feedback
  • Personalized student tracking
  • Analytics dashboards

3.2 Supported Subjects

  • Mathematics
  • English/Literature
  • Sciences (Physics, Chemistry, Biology)
  • History/Geography
  • Foreign Languages

4. FREE TRIAL AND SUBSCRIPTION

4.1 7-Day Free Trial

Access conditions:

  • Registration with valid personal information
  • Credit card required for identity verification
  • No billing during trial period
  • Full access to all premium features

End of free trial:

  • User may cancel anytime during the 7 days
  • Without cancellation, automatic subscription at current rate
  • First billing on 8th day after registration
  • Reminder email sent 48h before billing

4.2 Paid Subscriptions

Available plans:

  • Monthly subscription: $[Price]/month
  • Annual subscription: $[Price]/year (equivalent to $[Price]/month)
  • Educational plans: preferential rates upon request

Billing:

  • Automatic charge on due date
  • Invoice sent by email

5. PAYMENT TERMS

5.1 Accepted Payment Methods

  • Bank transfers (for annual subscriptions)
  • SEPA direct debits

5.2 Payment Security

  • No storage of banking data
  • PCI-DSS certified payment partners

5.3 Payment Failure

In case of payment failure:

  • Temporary service suspension after 48h
  • Automatic reminders for 15 days
  • Definitive termination after 15 days of non-payment

6. RIGHT OF WITHDRAWAL

In accordance with applicable consumer protection laws, users have 14 days to exercise their right of withdrawal, unless they have expressly consented to service commencement before the end of the withdrawal period.

  • Refund within 14 business days
  • Refund fees at our expense

7. TERMINATION

7.1 By User

  • Termination possible anytime via user interface
  • Effective at end of current billing period
  • No pro-rata refund
  • Data retention for 30 days after termination

7.2 By Notie AI

We reserve the right to terminate the contract in case of:

  • Non-compliance with these ToS
  • Fraudulent or abusive use of service
  • Persistent non-payment
  • 30-day notice except for gross misconduct

8. OBLIGATIONS AND RESPONSIBILITIES

8.1 Notie AI Obligations

  • Service provision with 99.5% availability rate
  • Regular maintenance and updates
  • Technical support in English and French
  • Data confidentiality compliance

8.2 User Obligations

  • Provision of accurate and current information
  • Use in accordance with service purpose
  • Respect for intellectual property rights
  • No attempts to bypass security measures

8.3 Limitation of Liability

Our liability is limited to amounts paid in the last 12 months. We cannot be held responsible for indirect damages, lost profits, or data loss not attributable to our fault.

9. INTELLECTUAL PROPERTY

9.1 Notie AI Rights

  • Platform, algorithms, and AI: exclusive ownership
  • Trademarks and logos: use strictly prohibited without authorization
  • Databases: sui generis protection

9.2 User Rights

  • Retention of all rights to submitted assignments
  • Non-exclusive license granted to Notie AI
  • Right to data erasure at any time

10. DATA PROTECTION

Personal data processing is governed by our Privacy Policy, compliant with GDPR and applicable data protection laws.

Main purposes:

  • Grading service provision
  • Customer relationship management
  • Algorithm improvement (anonymized data)

11. FORCE MAJEURE

Force majeure events include all unforeseeable, irresistible, and external events, including:

  • Natural disasters
  • Wars, terrorism
  • General strikes
  • Major internet infrastructure failures

12. APPLICABLE LAW AND JURISDICTION

These ToS are governed by French law. In case of dispute, and after attempted amicable resolution, Paris courts shall have exclusive jurisdiction.

13. MODIFICATIONS

Notie AI reserves the right to modify these ToS at any time. Users will be notified by email 30 days before modifications take effect.
